Lodha Trademark Dispute: Bombay High Court advice to Lodha brothers- ‘To resolve trademark dispute through mediation’

The Bombay High Court has asked the billionaire traders of the real estate region – Abhishek Lodha and Abhinandan Lodha to resolve the dispute through mediation in relation to the trademark ‘Lodha’. The bench with a single judge of Justice Arif Doctor asked whether any appropriate effort has been made to resolve the dispute.

He suggested that if the two sides agreed, a retired Chief Justice of India can be appointed for arbitration along with another senior member. Justice Arif Doctor said that this mediation will be done in the stipulated time and it will not take more than two weeks.

Darius Khambata, a lawyer for Macrotech Developers, told the court that he was not against mediation. He said that however, the House of Abhinandan Lodha (HOABL) and the concerned units should stop using the ‘Lodha’ trademark until the mediation continues.

A spokesman for Lodha Ventures, owned by Abhinandan Lodha, said he would run on the advice of the Bombay High Court. The court has asked both sides to explain whether they are ready to accept mediation on 28 January.

Earlier this month, Macrotech developers filed a case against HOABL in the Bombay High Court for the use of ‘Lodha’ and demanded compensation of Rs 5,000 crore.

During the company’s results meeting before the hearing on Monday, Abhishek Lodha said that this is a person personally sad for him as Abhinandan Lodha is his younger brother. He said, “I have always wished him very good and I hope that he will continue to succeed in all his fields including real estate.”
